Tax advantages of gift giving

The purchase of hampers for employees and customers can be used to promote happiness in the workplace, reward good efforts and thank a customer for their business. The added bonus is that the purchase of these items will also be a tax deduction for you.

Employee Gifts

You may wish to thank employees for their efforts. The purchase of a hamper of food and wine for an employee constitutes a tax deduction that is not subject to FBT. There is a "minor benefits" exemption that allows employers to provide gifts to employees with no FBT as long as they are inexpensive, irregular and infrequent. The amount you can spend per gift has increased from $100 to $300.

Client Gifts

The purchase of a hamper of food and wine or gifts for a customer as a ‘thank-you’ for their business or for a referral of new business is a tax deduction providing the contents are not consumed at your business premises and that it is given with the thought in mind of promoting more business which then generates more income. The ATO does not impose limits on gifts provided to clients. They are seen as promotional expenses and are therefore considered a deductible expense regardless of the cost.

Commission-Based Industries

For employees who work in fields such as real estate and insurance where their income is based on commission, gifts given to customers to promote repeat business are also a tax deduction.
